2. Description of Service

Our App provides a reading platform that allows users to:

• Read content in multiple languages
• Access word explanations and translations
• Store encrypted personal reading materials

3. User Content and Responsibilities

3.1 User-Generated Content

You are solely responsible for all content you upload, import, or store through the App ("User Content"). This includes but is not limited to:

• Text files and documents
• PDF files
• Links and web content
• Any other materials you choose to import

3.2 Content Ownership and Copyright

• You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and use all User Content
• You are solely responsible for ensuring that your User Content does not infringe upon any third-party copyrights, trademarks, patents, or other intellectual property rights
• We do not monitor, verify, or validate the copyright status of User Content due to encryption and privacy protections
• We cannot and do not determine whether User Content violates any copyright laws
• Copyright holders uploading their own content for the purpose of manufacturing infringement claims engage in bad faith conduct and may be subject to legal action for abuse of process
• Self-uploading of owned content does not constitute evidence of platform-enabled infringement

3.3 Prohibited Content and Bad Faith Actions

You agree not to upload or import content that:

• Infringes on intellectual property rights of others
• Contains malicious code, viruses, or harmful software
• Is illegal, defamatory, obscene, or violates any applicable laws
• Contains personal information of third parties without consent
• Violates any third-party terms of service or usage rights

You further agree not to:

• Upload content for the purpose of manufacturing false infringement claims
• Engage in entrapment or bad faith testing of the platform
• Make false representations about content ownership or authorization
• Use the platform to create artificial evidence of copyright violations

4. Intellectual Property Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your infringement of any intellectual property or other rights of any third party
• Any false, bad faith, or manufactured copyright claims you make
• Any entrapment or deceptive testing activities you engage in

5. Data Storage and Security

5.1 Data Encryption

• We encrypt and store your User Content on our servers
• Encryption is provided for security purposes, not for content validation or copyright compliance
• You remain fully responsible for the nature and legality of encrypted content

5.2 Data Usage

• We do not access, review, or monitor your encrypted User Content
• We provide storage and retrieval services only
• We do not endorse or validate any User Content

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
• ACCURACY OR COMPLETENESS OF TRANSLATIONS OR EXPLANATIONS
• UNINTERRUPTED OR ERROR-FREE SERVICE

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• DAMAGES ARISING FROM COPYRIGHT INFRINGEMENT CLAIMS RELATED TO USER CONTENT
• LOSSES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
• ANY CLAIMS RELATED TO THE ACCURACY OF TRANSLATIONS OR WORD EXPLANATIONS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Copyright Infringement Claims and Bad Faith Protection

8.1 DMCA Compliance

If you believe your copyrighted work has been uploaded by another user without authorization, please contact us with:

• Description of the copyrighted work
• Location of the allegedly infringing material
• Your contact information and good faith statement
• Electronic signature
• Sworn statement that you did not upload the content yourself

8.2 Bad Faith Claims Prevention

• Claims regarding content uploaded by the copyright holder themselves will be dismissed
• False DMCA claims may result in perjury charges under federal law
• Users who engage in bad faith testing or false claims may face legal action
• We reserve the right to pursue damages for abuse of process

8.3 Platform Protections

• Our encrypted storage model prevents us from proactively monitoring content
• We operate as a private storage service similar to cloud storage providers
• Copyright holders retain full rights to their own content when they upload it
• Self-uploading of owned content does not constitute platform-enabled infringement

8.4 User Responsibility

Users who upload copyrighted content without authorization may have their accounts terminated and may be liable for damages under applicable copyright laws.

9. Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Suspected copyright infringement
• Illegal or harmful activity
• Any reason at our sole discretion

10. Third-Party Services

The App may integrate with third-party services for translations and explanations. We are not responsible for the accuracy, availability, or terms of use of these third-party services.

11. Privacy and Data Protection

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
